Attorney's Dictionary of Patent Claims

Eric E. Bensen

Attorney's Dictionary of Patent Claims is an easy-to-use tool that patent prosecutors can rely on to quickly identify issued patents that have used a particular claim term in order to address an examiner objection to the effect that the term is indefinite. Many thousands of terms drawn from all of the patent arts are included each with an identification of at least one, although often multiple, issued patents that used the term, which patents can demonstrate that in similar contexts, the term was not considered indefinite by the Patent & Trademark Office.  Other sections of the book allow a prosecutor to search by patent classification or by patent number.

Beginning with the 2026 release, in order to provide an additional helpful resource to prosecutors, this work will also include an authoritative discussion of canons of claim construction.
